I defend a novel account of scientific progress centred around justification. Science progresses, on this account, where there is a change in justification. I consider three options for explicating this notion of change in justification. This account of scientific progress dispels with a condition for scientific progress that requires accumulation of truth or truthlikeness, and it emphasises the social nature of scientific justification.

Both Maimonides and St. Thomas Aquinas occupy a unique position in their respective religious milieux. Each aimed to reconcile Aristotelian thought with the theology of his own faith. Their gigantic endeavors did not meet with immediate and unanimous approval among the conservative spokesmen of their coreligionists. Efforts had been made already within their lifetimes to have their views censored. Maimonides’s Guide to the Perplexed, completed in 1185 raised bitter controversies among Jews, and for a century at least almost every Jewish (...) scholar of note was either an ardent opponent or an equally ardent apologist for the Sage of Cordova. Enmity between both parties was heated to such a point that the dispute was referred by the anti-Maimonists in 1234 to a Christian authority, the papal legate at Montpellier, who ordered Maimonides’s works to be burned. When the controversy quieted down, Maimonides’s works became the centre of Jewish thought throughout the ages. (shrink)

This classic work on the Christian message speaks directly to all who seek genuine religious experience.

The article analyses the constitution of subjectivity in Ruben Östlund’s film Force Majeure. At the centre of attention stands the male protagonist who is uncapable of reconciling his inner nature with the external expectations. If the film may be un- derstood as a critique of existing middle-class conventions, it also reproduces a highly conventional ideal of the self-identical subject. The article argues that this confusion or irony is an expression of a Cartesian subject – still prevalent in the film (...) – in crisis. A neglected aspect of Descartes’ theory is that the autonomy of the subjects presupposes the existence of God. The problem for Östlund’s char- acters is that there is no God. Still, they act as if he, or as if any au- thority might, legitimize their subjectivity. Thus, the whole existence becomes a series of performances. The idea of an inner nature cor- responds with the notion of an outer nature. The latter is certainly very present in Force Majeure, but at the same time this nature is constantly problematized. On an allegorical level, the film may thus be read as a comment on the Anthropocene, a state where we no longer know neither what “nature”, nor “culture” is. (shrink)

Nietzsche described himself as the first psychologist of the West. His interpreters, however, have seldom regarded his works as contributions to psychology. This book gives the psychological perspective a central role and uses it as a guide through Nietzsche's aphoristic maze toward the centre of his thought, method, aims and ramifications. Psychology thus serves as the path to his philosophy and leads to a reconstruction of his substantive theses, including the morality of positive power. Often, a more or less universal quality is attributed to certain legal concepts. For refugee scholars working between 1933 and 1945, the universal quality of these concepts was challenged on two fronts: first, the breaking down of the Weimar Constitution and the German Rechtsstaat under Nazi rule demonstrated the fragility of a constitutional and legal order. Moreover, the breakdown of the German Rechtsstaat was felt on a deeper conceptual level. ‘Immutable’ legal concepts turned out to be easily mutated to conform (...) to Nazi ideology. The second major challenge to the universality of concepts thus pertains to the universal characteristics of the ‘concept of a concept’ itself. In brief, what German refugee legal scholars attempted to create in the course of the 1930s and 1940s was a ‘universal’ Rechtsstaat centred around concepts and legal scholarship that would avoid the breakdown by placing it into a feasible and balanced system of legal enforcement on an international level. Thus, in their new academic context, rather than dismissing the Rechtsstaatliche function of legal concepts and the role of legal scholars, refugee scholarship ventured to enhance it. This contribution argues that the development of Hersch Lauterpacht’s concept of human rights constitutes such an enhancement. (shrink)

I explore Martin Heidegger’s figure of the last god found in his middle period of thinking from 1936–1939 centring my analysis on Contributions to Philosophy: Of the Event (Beiträge) and how this conception is messianic in nature. The last god is a particular instantiation of a being among beings rather than representing a literary or philosophical structure that lies ahead in the future. I emphasise the notion of the turning that occurs within Ereignis, a revived playfulness, wherein the lightning-flash (das (...) Blitzen) appears as a trace or guide towards a new beginning. I conclude by investigating the historical and cultural ramifications that the arrival of the last god would have. (shrink)

AbstractThe Green Revolution still exerts an important influence on agricultural policy as a technology-centred development strategy. A main policy narrative underpinning the Green Revolution was first expounded in Transforming Traditional Agriculture, a book published in 1964 by Nobel Prize-winning economist Ted Schultz. He famously argued that traditional farmers were ‘poor but efficient’. As farmers responded to economic incentives, technology-driven strategies would transform traditional agriculture into an engine of economic growth. Schultz relied on published ethnographic data and his own calculations to (...) construct this policy narrative. My reanalysis of TTA focuses on its main case study, Panajachel, a village in Guatemala. I follow a narrative approach, evaluating whether Schultz’s story relates a plausible account of agricultural development in Panajachel and its region. I show how Schultz deliberately tried to hide that Mayan farmers in Panajachel were not challenged in technological terms and were able to reach relatively high economic returns. His interpretation of the Guatemalan rural economy ignored ethnic tensions dominating market exchange, a main barrier for agricultural development. I evaluate Schultz’s narrative further by tracing the subsequent evolution of Panajachel and its wider region. High-input strategies had to address ethnic barriers and change agents became embroiled in violent conflict along ethnic lines. Assessing the adequacy of Schultz’s contribution, from a narrative approach, shows how he ‘got the story wrong’ and that the Green Revolution policy narrative has an excessively narrow intellectual basis. New narratives should reserve a much more important place for institutional change in agricultural development. (shrink)

An implicit assumption in most works on change recipient reactions is that employees are self-centred and driven by a utilitarian perspective. According to large parts of the organizational change literature, employees’ reactions to organizational change are mainly driven by observations around the question ‘what will happen to me?’ We analysed change recipients’ reactions to 26 large-scale planned change projects in a policing context on the basis of 23 in-depth interviews. Our data show that change recipients drew on observations with three (...) foci to assess change, making sense of change as multidimensional and mostly ambivalent in nature. In their assessment of organizational change, recipients care not only about their own personal outcomes, but go beyond self-interested concerns to show a genuine interest in the impact of change on their colleagues and organization. Meaningful engagement of employees in organizational change processes requires recognizing that reactions are not simply ‘all about me’. We add to the organizational change literature by introducing a behavioural ethics perspective on change recipients’ reactions highlighting an ethical orientation where moral motives that trigger change reactions get more attention than is common in the change management literature. Beyond the specifics of our study, we argue that the genuine concern of change recipients for the wellbeing of others, and the impact of the organizations’ activities on internal and external stakeholders, needs to be considered more systematically in research on organizational change. Globalisation develops at a staggering pace that envelopes and infiltrates local South African communities in various ways. Through technology a person can have access to anything today. Should the church try to keep up, or compete with such a reality? This article aims to encourage the church to develop a responsible missional character, which embraces the opportunities globalisation offers – to be a participative forum in a community comprising of more than religious people. Through re-evaluating the church’s missional intent, by (...) shifting the paradigm away from self-centred outcomes, the church should contribute to such a community’s articulation of faith. Narrative is everywhere and has unique powers: to enchant and inspire, to make sense of our lives and ourselves and to afford us an enriched understanding of alternative worlds and lives and of better futures - though narrative also has the potential to coerce and oppress. Narrative is at the centre at all stages of the English curriculum and has been the subject of a burgeoning critical industry. This timely volume addresses the many ways in which recent thinking has (...) informed the teaching of narrative in university classrooms in the UK and the USA. Distinguished teachers from both countries range widely across narrative topics and genres, including the opportunities opened up by new technologies, and chapters articulate students' own individual and collaborative experiences in the teaching/learning process. The result is a volume that explores the pleasurable challenges of working with students to help them appreciate and assess the power that narrative exerts, to become reflective critics of its inner workings as well as exponents of narrative themselves. Abstract This paper argues that in modern (agro)biotechnology, (un)naturalness as an argument contributed to a stalemate in public debate about innovative technologies. Naturalness in this is often placed opposite to human disruption. It also often serves as a label that shapes moral acceptance or rejection of agricultural innovative technologies. The cause of this lies in the use of nature as a closed, static reference to naturalness, while in fact “nature” is an open and dynamic concept with many different meanings. We (...) propose an approach for a dynamic framework that permits an integrative use of naturalness in debate, by connecting three sorts of meaning that return regularly in the arguments brought forward in debate; cultural, technological, and ecological. We present these as aspects of nature that are always present in the argument of naturalness. The approach proposes a dynamic relation between these aspects, formed by gradients of naturalness, which in turn are related to ethical concerns. In this way we come to an overview that makes it possible to give individual arguments a relative place and that does justice to the temporality of the concept of nature and the underlying ethical concerns stakeholders have in respect to innovation in agriculture. This article stems from my presentation at the 2020 Symposium of the Kripke Center for the Study of Religion and Society, whose theme was "Religion and the New Politics." The article is written for an interdisciplinary audience. Drawing on resources from the philosophical tradition of phenomenology and putting them into dialogue with an important theme in Christian theology, I argue that there is a distinctly non-discursive, embodied form of racism that should be recognized and addressed by the new politics. Because (...) this form of racism occurs not at the familiar level of discourse (word), but in the often unconscious habitualities of the lived body (flesh), it resists common antiracist strategies, and seems to be outside the purview of responsibility and of willful, rational change (the logos). I situate these underlying issues with regard to the traditional opposition between mind and body, and then offer a reinterpretation of them by way of some key phenomenological concepts: intentionality, the lived body, the critique of scientism, motivation, and empathy. I conclude that embodied racism is something which is open to an extended conception of rationality that includes the lived body, and for which we are responsible. I then suggest some antiracist political strategies that put these theoretical considerations to use through attention to embodied spaces and practices. (shrink)

In this paper, we will critically examine the notion of rationality and the disabling instinct of self-preservation that play out in human relationships. That “man is a rational animal,” as Aristotle declared is usually taken for granted in social studies. But whether humans act rationally all the time, and in all circumstances remains questionable. Here, we shall investigate this concern from a decolonial perspective by engaging some contradictions thrown up in the context of coloniality within which a section of humanity (...) dehumanizes the rest. The question then is, how rational is the intellectual program of coloniality? Taking a cue from conversational thinking that places the notion of relationship at the center of decolonial analysis, we argue that coloniality fractures the inter and intra-racial relationships due mainly to the instinct of self-preservation that overwhelms human rationality. What has emerged today as the superior/inferior divide, racialism, classism, internal colonialism, ethnic cleansing, apartheid, xenophobia, and genocide are some of the consequences of warped and uncritical thinking driven by an extreme form of the instinct of self-preservation. We argue that the promotion of critical (higher-order) thinking in addition to ordinary (lower-order) thinking could be crucial in a decolonial program. (shrink)

Gender‐affirming care is almost exclusively discussed in connection with transgender medicine. However, this article argues that such care predominates among cisgender patients, people whose gender identity matches their sex assigned at birth. To advance this argument, we trace historical shifts in transgender medicine since the 1950s to identify central components of “gender‐affirming care” that distinguish it from previous therapeutic models, such as “sex reassignment.” Next, we sketch two historical cases—reconstructive mammoplasty and testicular implants—to show how cisgender patients offered justifications grounded (...) in authenticity and gender affirmation that closely mirror rationales supporting gender‐affirming care for transgender people. The comparison exposes significant disparities in contemporary health policy regarding care for cis and trans patients. We consider two possible objections to the analogy we draw, but ultimately argue that these disparities are rooted in “trans exceptionalism” that produces demonstrable harm.. (shrink)

THE FREEHOF INSTITUTE OF PROGRESSIVE HALAKHAH The Freehof Institute of Progressive Halakhah is a creative research center devoted to studying and defining the progressive character of the halakhah in accordance with the principles and theology of Reform Judaism. It seeks to establish the ideological basis of Progressive halakhah, and its application to daily life. The Institute fosters serious studies, and helps scholars in various portions of the world to work together for a common cause. It provides an ongoing forum through (...) symposia, and publications including the quarterly newsletter, HalakhaH, published under the editorship of Walter Jacob, in the United States. The foremost halakhic scholars in the Reform, Liberal, and Progressive rabbinate along with some Conservative and Orthodox colleagues as well as university professors serve on our Academic Council. This collection of essays is the product of the symposia held in Atlanta and Pittsburgh in 1995 and 1996. Human vision raises a number of puzzles. Among them are the puzzles of visual experience: how to provide a scientific understanding of the phenomenal character of the visual experiences of the shapes, textures, colors, orientations and motion of perceived objects? How can a purely subjective visual experience be the basis of so much objective knowledge of the world? Visually guided actions raise a different puzzle: how can actions directed towards a target be so accurate in the absence of the agent’s (...) awareness of many of the target’s visual attributes? Ways of Seeing has three related goals, the first of which is to make the case for a broadly representational approach to the above set of puzzles. The second goal of WoS is to argue that the version of the ‘two-visual systems’ model of human vision best supported by the current empirical evidence has the resources to solve the puzzle of visually guided actions, which has been at the center of much recent work in the cognitive neuroscience of vision and action. The third goal of WoS is to draw attention to some of the tensions between acceptance of the two-visual systems model of human vision and some influential views about the nature and function of the content of visual experience espoused by philosophers in response to the puzzles raised by visual experience. An individual's health, genetic, or environmental-exposure data, placed in an online repository, creates a valuable shared resource that can accelerate biomedical research and even open opportunities for crowd-sourcing discoveries by members of the public. But these data become “immortalized” in ways that may create lasting risk as well as benefit. Once shared on the Internet, the data are difficult or impossible to redact, and identities may be revealed by a process called data linkage, in which online data sets are matched (...) to each other. Reidentification, the process of associating an individual's name with data that were considered deidentified, poses risks such as insurance or employment discrimination, social stigma, and breach of the promises often made in informed-consent documents. At the same time, re-ID poses risks to researchers and indeed to the future of science, should re-ID end up undermining the trust and participation of potential research participants. The ethical challenges of online data sharing are heightened as so-called big data becomes an increasingly important research tool and driver of new research structures. Big data is shifting research to include large numbers of researchers and institutions as well as large numbers of participants providing diverse types of data, so the participants’ consent relationship is no longer with a person or even a research institution. In addition, consent is further transformed because big data analysis often begins with descriptive inquiry and generation of a hypothesis, and the research questions cannot be clearly defined at the outset and may be unforeseeable over the long term. In this article, we consider how expanded data sharing poses new challenges, illustrated by genomics and the transition to new models of consent. We draw on the experiences of participants in an open data platform—the Personal Genome Project—to allow study participants to contribute their voices to inform ethical consent practices and protocol reviews for big-data research. For all of the emphasis on quality improvement—as well as the acknowledged overlap between assessment of the quality of healthcare services and clinical ethics—the quality of clinical ethics consultation has received scant attention, especially in terms of empirical measurement. Recognizing this need, the second edition of Core Competencies for Health Care Ethics Consultation identified four domains of ethics quality: (1) ethicality, (2) stakeholders’ satisfaction, (3) resolution of the presenting conflict/dilemma, and (4) education that translates into knowledge. This study is the (...) first, to our knowledge, to directly measure all of these domains. Here we describe the quality improvement process undertaken at a tertiary care academic medical center, as well as the tools developed to measure the quality of ethics consultation, which include post-consultation satisfaction surveys and weekly case conferences. The information gained through these tools helps to improve not only the process of ethics consultation, but also the measurement and assurance of quality. (shrink)

In his recent book “Becoming Human” Michael Tomasello delivers an updated version of his shared intentionality (SI) account of uniquely human cognition. More so than in earlier writings, the author embraces the idea that SI shapes not just our social cognition but all domains of thought and emotion. In this critical essay, we center on three parts of his theory. The first is that children allegedly have to earn the status of “second persons” through the acquisition of collective intentionality at (...) age 3. We make the case that humans take a second-personal stance toward others even as infants. The second point concerns Tomasello’s claim that 3-year-olds are group-minded and think in terms of “us” vs. “them”. We doubt both that children this young have a clear overview of their in- and out-groups and that they possess the “agonistic spirit” necessary for inter-group competition. Third, due to his focus on collective intentionality and how it might explain 3-year-olds’ difficulties with theory of mind problems, Tomasello appears to pay less attention to the crucial conceptual change that allows 4- to 5-year-olds to master such tasks. In the 1980s, a number of philosophers argued that perception is analog. In the ensuing years, these arguments were forcefully criticized, leaving the thesis in doubt. This paper draws on Weber’s Law, a well-entrenched finding from psychophysics, to advance a new argument that perception is analog. This new argument is an adaptation of an argument that cognitive scientists have leveraged in support of the contention that primitive numerical representations are analog. But the argument here is extended to the representation of (...) non-numerical magnitudes, such as luminance and distance, and shown to apply to perception and not just cognition. The relevant sense of ‘analog’ is also clarified, and two powerful objections are addressed. Finally, the question whether perception’s analog vehicles are located in conscious experience is explored and related to a well-known controversy within psychophysics. (shrink)

Philosophy, scientific psychology, and common sense all distinguish perception from cognition. While there is little agreement about how the perception–cognition boundary ought to be drawn, one prominent idea is that perceptual states are dependent on a stimulus, or stimulus-dependent, in a way that cognitive states are not. This paper seeks to develop this idea in a way that can accommodate two apparent counterexamples: hallucinations, which are prima facie perceptual yet stimulus-independent; and demonstrative thoughts, which are prima facie cognitive yet stimulus-dependent. According to the Generality Constraint, mental states with conceptual content must be capable of recombining in certain systematic ways. Drawing on empirical evidence from cognitive science, I argue that so-called analogue magnitude states violate this recombinability condition and thus have nonconceptual content. I further argue that this result has two significant consequences: it demonstrates that nonconceptual content seeps beyond perception and infiltrates cognition; and it shows that whether mental states have nonconceptual content is largely an empirical matter determined by the (...) structure of the neural representations underlying them. This article examines the recent trial of ANC president Jacob Zuma, and how gender power was framed in respect to, and within, the politics of culture. The trial centred on allegations of rape by Zuma of an HIV positive woman many years his junior, who was also the daughter of a former anti-apartheid struggle comrade. All of these details were considered pertinent, not only to the legal debates about whether a crime had been committed, but also to the political (...) debates raging around the nation's key challenges of high rates of sexual violence and the 'denialist' state response to devastating levels of HIV infection. Many Zuma supporters saw the accusation of rape as politically motivated and as evidence of an anti-Zuma conspiracy. In visibly smaller numbers, women's rights groups were present on the streets as well, trying to draw attention to the general problem of the nation's extraordinarily high rates of sexual violence and the general failure of the justice system to address cases of rape. The article argues that the fervour surrounding this trial, the burning political question of women's status was continually cast as a private matter: debates about relations between men and women came to be focused on issues of propriety, behaviour and etiquette rather than on questions about rights and power. In short, the privatisation of gender was effected through the politics of culture. As culture is politicised as a legal and secular 'right', gender is de-politicised to become a normatively 'private' and 'customary' domain. In The Border between Seeing and Thinking, Ned Block argues that the distinction between perception and cognition should be grounded in representational format. I object that cognition is multifaceted, and includes representations with the same format as some perceptual representations. We can save Block’s view by interpreting it as concerning the border between one elite species of cognition—namely, propositional thought—and everything below it, including perception. But that leaves the border between perception and cognition in general unexplained. To fill this gap, (...) I recommend my stimulus-dependence account of the border and reply to objections Block raises against it. This brings into relief a category of mind that is crucial to understanding human infants and nonhuman animals—namely, nonpropositional cognition, which sits between perception and propositional thought. John Morrison has argued that confidences are assigned in perceptual experience. For example, when you perceive a figure in the distance, your experience might assign a 55-percent confidence to the figure’s being Isaac. Morrison’s argument leans on the phenomenon of ‘completely trusting your experience’. I argue that Morrison presupposes a problematic ‘importation model’ of this familiar phenomenon, and propose a very different way of thinking about it. While the article’s official topic is whether confidences are assigned in perceptual experience, it (...) is also about two more general issues: how we can determine which properties are assigned in perceptual experience; and how we transition from perception to belief. The ‘expropriation of the expropriators’ is a delicious turn of phrase, one that Marx even compares to Hegel’s infamous ‘negation of the negation’. But what does it mean, and is it still relevant today? Before I analyse the content of Marx’s expression, I briefly consider contemporary legal understandings of expropriation, as well as some examples of it. In the remainder of the essay, I spell out different kinds of expropriation in Marx and focus on an ambiguity at the core of (...) the notion of ‘expropriating the expropriators’, namely, whether it describes an immanent and objective tendency within the development of the capitalist mode of production or else actively prescribes a form of revolutionary political praxis for the working class. My answer is that it does both, though not without tension. Finally, I develop some implications of these reflections by showing how the concept of expropriation can be put to use today, in struggles around housing, climate and work. (shrink)

I offer here a new hypothesis about the nature of implicit attitudes. Psy- chologists and philosophers alike often distinguish implicit from explicit attitudes by maintaining that we are aware of the latter, but not aware of the former. Recent experimental evidence, however, seems to challenge this account. It would seem, for example, that participants are frequently quite adept at predicting their own perfor- mances on measures of implicit attitudes. I propose here that most theorists in this area have nonetheless overlooked (...) a commonsense distinction regarding how we can be aware of attitudes, a difference that fundamentally distinguishes implicit and explicit attitudes. Along the way, I discuss the implications that this distinction may hold for future debates about and experimental investigations into the nature of implicit attitudes. (shrink)

Empirical discussions of mental representation appeal to a wide variety of representational kinds. Some of these kinds, such as the sentential representations underlying language use and the pictorial representations of visual imagery, are thoroughly familiar to philosophers. Others have received almost no philosophical attention at all. Included in this latter category are analogue magnitude representations, which enable a wide range of organisms to primitively represent spatial, temporal, numerical, and related magnitudes. The animal agriculture industry causes animals a tremendous amount of pain and suffering. Many ethical vegans argue that we therefore have an obligation to abstain from animal products in order to reduce this suffering. But this argument faces a challenge: thanks to the size and structure of the animal agriculture industry, any individual’s dietary choices are overwhelmingly unlikely to make a difference. In this paper, we criticize common replies to this challenge and develop an alternative argument for ethical veganism. Specifically, (...) we argue that individuals should abstain from animal products because vegans, as a group, successfully reduce animal suffering, and individuals are obligated to participate in, rather than free ride on, this collective endeavor. Wigner's quantum-mechanical classification of particle-types in terms of irreducible representations of the Poincaré group has a classical analogue, which we extend in this paper. We study the compactness properties of the resulting phase spaces at fixed energy, and show that in order for a classical massless particle to be physically sensible, its phase space must feature a classical-particle counterpart of electromagnetic gauge invariance. By examining the connection between massless and massive particles in the massless limit, we also derive a classical-particle (...) version of the Higgs mechanism. (shrink)

A background assumption in much contemporary political philosophy is that justice is the first virtue of social institutions, taking priority over other values such as beneficence. This assumption is typically treated as a methodological starting point, rather than as following from any particular moral or political theory. In this paper, I challenge this assumption. To frame my discussion, I argue, first, that justice doesn’t in principle override beneficence, and second, that justice doesn’t typically outweigh beneficence, since, in institutional contexts, the (...) stakes of beneficence are often extremely high. While there are various ways one might resist this argument, none challenge the core methodological point that political philosophy should abandon its preoccupation with justice and begin to pay considerably more attention to social beneficence—that is, to beneficence understood as a virtue of social institutions. Along the way, I also highlight areas where focusing on social beneficence would lead political philosophers in new and fruitful directions, and where normative ethicists focused on personal beneficence might scale up their thinking to the institutional case. Drawing on the empirical premise that attention makes objects look more intense, Ned Block has argued for mental paint, a phenomenal residue that cannot be reduced to what is perceived or represented. If sound, Block's argument would undermine direct realism and representationism, two widely held views about the nature of conscious perception. We argue that Block's argument fails because the empirical premise it is based upon is false. Attending to an object alters its salience, but not its perceived intensity. We (...) also argue that salience should be equated with mental primer, a close cousin of mental paint that reintroduces difficulties for direct realism and representationism. The upshot is that direct realism and representationism are still in trouble, but not for the reason that Block thinks. (shrink)

Building on Christopher Peacocke’s account of analog perceptual contentand my own account of analog perceptual vehicles, I defend three claims: that theperception of magnitudes often has analog contents; that the perception of magni-tudes often has analog vehicles; and that the first claim is true in virtue of the second—that is, the analog vehicles help to ground the analog contents.

Medical nihilism is the view that we should have little confidence in the effectiveness of medical interventions. Jacob Stegenga argues persuasively that this is how we should see modern medicine, and suggests that medical research must be modified, clinical practice should be less aggressive, and regulatory standards should be enhanced.

Our world is complex—it is composed of many interacting parts—and this complexity poses a serious difficulty for theorists of social reform. On the one hand, we cannot merely work out ways of ameliorating immediate problems of injustice, because the solutions we generate may interact to set back the achievement of overall long-term justice. On the other, we cannot supplement such problem solving with theorizing about how to make progress towards a long-term goal of ideal justice, because the very interactions that (...) render problem solving unsatisfactory raise insurmountable epistemic difficulties for this latter approach. To accommodate complexity, we must therefore give up on ideal theory, and instead supplement problem solving with a new sort of theorizing that aims to work out how to make our institutional arrangements more progressive: more conducive to further improvements in general, though not necessarily to the achievement of any antecedently specified goal. More concretely, we must identify ways of improving our capacity to flexibly experiment with many promising solutions to problems as they arise, to select for those solutions that prove successful while eliminating those that do not, and to learn from both our successes and our inevitable failures. According to Rosenthal's higher-order thought (HOT) theory of consciousness, one is in a conscious mental state if and only if one is aware of oneself as being in that state via a suitable HOT. Several critics have argued that the possibility of so-called targetless HOTs?that is, HOTs that represent one as being in a state that does not exist?undermines the theory. Recently, Wilberg (2010) has argued that HOT theory can offer a straightforward account of such cases: since consciousness is a (...) property of mental state tokens, and since there are no states to exhibit consciousness, one is not in conscious states in virtue of targetless HOTs. In this paper, I argue that Wilberg's account is problematic and that Rosenthal's version of HOT theory, according to which a suitable HOT is both necessary and sufficient for consciousness, is to be preferred to Wilberg's account. I then argue that Rosenthal's account can comfortably accommodate targetless HOTs because consciousness is best understood as a property of individuals, not a property of states. (shrink)

Although considerable attention has been devoted to the concepts of “visible” and “invisible” victims in general medical practice, especially in relation to resource allocation, far less consideration has been devoted to these concepts in behavioral health. Distinctive features of mental health care in the United States help explain this gap. This essay explores three specific ways in which the American mental health care system protects potentially “visible” individuals at the expense of “invisible victims” and otherwise fails to meet the needs (...) of great numbers of people with serious psychiatric conditions: prioritization of the wrong patients, incentivization of excessive caution among providers, and a narrow definition of psychiatry's purview. While each of these practices has been discussed elsewhere in the literature, they are rarely considered as part of an interrelated and systemic problem. Reconceptualizing these three issues as aspects of the larger conflict between the interests of “visible” and “invisible” victims may prove a path toward reform. (shrink)

I motivate and defend a previously underdeveloped functionalist account of the metaphysics of color, a view that I call ‘quality-space functionalism’ about color. Although other theorists have proposed varieties of color functionalism, this view differs from such accounts insofar as it identifies and individuates colors by their relative locations within a particular kind of so-called ‘quality space’ that reflects creatures’ capacities to discriminate visually among stimuli. My arguments for this view of color are abductive: I propose that quality-space functionalism best (...) captures our commonsense conception of color, fits with many experimental findings, coheres with the phenomenology of color experience, and avoids many issues for standard theories of color such as color physicalism and color relationalism.
